1. Acceptance of Terms

By using GenFitAI, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

GenFitAI is an AI-powered fitness training platform that provides:

• Exercise library with detailed instructions and demonstrations

• Subscription-based premium features and content

3. Subscription Terms

3.1 Subscription Plans

GenFitAI offers subscription plans including:

• Monthly subscription at $5.00 USD
• Annual subscription at $20.00 USD (67% savings)

3.2 Auto-Renewal

Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and turn off auto-renewal in your Account Settings at any time after purchase.

3.3 Payment and Billing

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

3.4 Cancellation

You may cancel your subscription at any time by going to your Account Settings after purchase. Cancellation will take effect at the end of the current billing period.

3.5 Refunds

Refunds are subject to Apple's App Store refund policy. We do not provide refunds for subscription fees except as required by law.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.

• You participate in any exercise program at your own risk
• You are responsible for ensuring you are physically capable of performing exercises
• You should stop exercising immediately if you experience pain or discomfort

5.3 AI Recommendations Disclaimer

While our AI system provides personalized recommendations, these are suggestions only and should not be considered as professional fitness advice. You are responsible for:

• Evaluating the appropriateness of AI-generated recommendations
• Modifying exercises to suit your fitness level and limitations

You agree not to use the service to:

• Attempt to reverse engineer, decompile, or disassemble the application

AI-generated workout plans and recommendations are provided for your personal use only. You may not reproduce, distribute, or commercialize AI-generated content without our express written consent.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.

10. Limitation of Liability

In no event shall GenFitAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

This includes but is not limited to:

• Injuries or health issues arising from exercise recommendations
• Any damages exceeding the amount you paid for the service
• Damages resulting from AI-generated content or recommendations

11. Disclaimers

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. GenFitAI disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

This includes but is not limited to:

• Warranties that the service will meet your specific requirements
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that defects will be corrected

12. Indemnification

You agree to indemnify and hold harmless GenFitAI and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of any third-party rights
• Any injuries or damages resulting from your use of the service
