End User License Agreement for GenFitAI

This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and GenFitAI ("we," "us," or "our") for the GenFitAI mobile application, including any associated software components, media, printed materials, and online or electronic documentation (collectively, the "Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the Application.

1. LICENSE GRANT

Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on your personal mobile device
• Use the Application for your personal, non-commercial fitness and training purposes
• Access the Application's features and services in accordance with this EULA

2. DESCRIPTION OF THE APPLICATION

GenFitAI is an AI-powered fitness training application that provides:

• Personalized AI-generated workout plans and training recommendations
• Exercise library with detailed instructions and demonstrations
• Progress tracking and fitness analytics
• Multi-language support for global accessibility
• Integration with health platforms and fitness devices
• Subscription-based premium features and content

3. SUBSCRIPTION TERMS

3.1 Subscription Plans

The Application offers subscription plans including:

• Monthly subscription at $5.00 USD
• Annual subscription at $20.00 USD (67% savings)

3.2 Auto-Renewal

Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and turn off auto-renewal in your Account Settings at any time after purchase.

3.3 Payment and Billing

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

3.4 Cancellation

You may cancel your subscription at any time by going to your Account Settings after purchase. Cancellation will take effect at the end of the current billing period.

3.5 Refunds

Refunds are subject to Apple's App Store refund policy. We do not provide refunds for subscription fees except as required by law.

4. HEALTH AND SAFETY DISCLAIMERS

4.1 Medical Disclaimer

IMPORTANT: The Application is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or fitness program.

4.2 Exercise at Your Own Risk

You acknowledge that:

• Physical exercise involves inherent risks of injury
• You participate in any exercise program at your own risk
• You are responsible for ensuring you are physically capable of performing exercises
• You should stop exercising immediately if you experience pain or discomfort

4.3 AI Recommendations Disclaimer

While our AI system provides personalized recommendations, these are suggestions only and should not be considered as professional fitness advice. You are responsible for:

• Evaluating the appropriateness of AI-generated recommendations
• Modifying exercises to suit your fitness level and limitations
• Consulting with fitness professionals when necessary

5. DATA COLLECTION AND PRIVACY

5.1 Health and Fitness Data

The Application may collect, store, and process:

• Personal fitness data (workout history, progress metrics)
• Health information you choose to provide
• Device and usage analytics
• Performance and training data

5.2 Data Usage for AI Features

Your fitness data may be used to:

• Improve AI training recommendations
• Personalize your workout experience
• Enhance the Application's features and functionality
• Provide better user experience and support

5.3 Third-Party Integrations

The Application may integrate with third-party health platforms (e.g., Apple Health, Google Fit). Data sharing with these platforms is subject to their respective privacy policies.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Application Ownership

The Application and its original content, features, and functionality are owned by GenFitAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User-Generated Content

You retain ownership of any content you create within the Application. By using the Application, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving the Application's services.

6.3 AI-Generated Content

AI-generated workout plans and recommendations are provided for your personal use only. You may not reproduce, distribute, or commercialize AI-generated content without our express written consent.

7. PROHIBITED USES

You agree not to:

• Use the Application for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the Application
• Modify, adapt, or create derivative works of the Application
• Use the Application to harm, harass, or intimidate others
• Share your account credentials with others
• Use the Application to collect or store personal data about other users
• Interfere with or disrupt the Application's functionality
• Use the Application for commercial purposes without our written consent

8. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Application will meet your specific requirements
• Warranties that the Application will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that defects will be corrected

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL GENFITAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use of the Application
• Injuries or health issues arising from exercise recommendations
• Any damages exceeding the amount you paid for the Application

10. INDEMNIFICATION

You agree to indemnify and hold harmless GenFitAI and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Application
• Your violation of this EULA
• Your violation of any third-party rights
• Any injuries or damages resulting from your use of the Application

11. TERMINATION

11.1 Termination by You

You may terminate this EULA at any time by:

• Uninstalling the Application from your device
• Discontinuing use of the Application
• Contacting us to request account deletion

11.2 Termination by Us

We may terminate this EULA immediately if:

• You breach any terms of this EULA
• You engage in fraudulent or illegal activities
• We discontinue the Application or service
• Required by law or regulation

11.3 Effect of Termination

Upon termination:

• Your right to use the Application ceases immediately
• You must uninstall the Application from your device
• We may delete your account and associated data
• No refunds will be provided except as required by law

12. UPDATES AND MODIFICATIONS

12.1 Application Updates

We may provide updates to the Application from time to time. Updates may be automatic or require your consent. You agree to receive and install updates to ensure optimal functionality and security.

12.2 EULA Updates

We reserve the right to modify this EULA at any time. Material changes will be communicated to you through the Application or via email. Your continued use of the Application after such modifications constitutes acceptance of the updated EULA.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction where GenFitAI operates, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

14. SEVERABILITY

If any provision of this EULA is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15. ENTIRE AGREEMENT

This EULA, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between you and GenFitAI regarding the Application and supersedes all prior agreements and understandings.
